These SMS Program Terms and Conditions apply to the SMS messaging program operated by Artificer's AI Solutions, ABN 64 207 782 419, trading as Artificer's AI ("Artificer's AI", "we", "us" or "our").

1. Program name

The program is called the Artificer's AI SMS Program.

2. Program description

By opting in to the Artificer's AI SMS Program, you agree to receive SMS messages from Artificer's AI at the mobile number you provide.

Messages may include:

Responses to enquiries;
Consultation, meeting and appointment confirmations or reminders;
Quotes, proposals and service-related follow-ups;
Project, account and customer-support updates;
Information about our AI systems, automation, software development and training services; and
Promotional offers or other marketing messages where you have consented to receive them.

Message frequency varies depending on your enquiries, appointments, services and communication preferences. Participation in the SMS Program is voluntary.

You may join the SMS Program by submitting an online form, requesting SMS communication, responding to an invitation to opt in, or using another consent method made available by Artificer's AI.

By opting in, you confirm that:

You are the owner or authorised user of the mobile number provided;
The information you provide is accurate; and
You consent to receiving SMS messages from Artificer's AI for the purposes described when you opt in.

Consent to receive marketing SMS messages is not a condition of purchasing our services unless clearly stated otherwise in relation to a particular service.

4. Opting out

You may cancel the SMS service at any time by replying STOP to an SMS message from Artificer's AI.

After receiving your STOP request, we may send one final SMS confirming that you have been unsubscribed. You will then cease receiving SMS messages covered by your request.

We will action unsubscribe requests as soon as reasonably practicable and no later than five working days after receiving a valid request.

Other words or statements that clearly indicate that you no longer wish to receive SMS messages may also be treated as unsubscribe requests.

5. Rejoining the program

After opting out, you may rejoin the Artificer's AI SMS Program by submitting a new opt-in form, providing fresh consent through another enrolment method offered by us, or replying START where that functionality is supported.

Your previous consent will not automatically be reinstated simply because you contact us for another purpose.

7. Message and data charges

Message and data rates may apply to SMS messages sent to you by Artificer's AI and messages you send to us.

Any charges are determined by your mobile service provider and your mobile plan. Contact your mobile service provider for information about your SMS and data charges.

8. Carrier liability

Mobile carriers and telecommunications providers are not responsible or liable for delayed or undelivered messages.

SMS delivery depends on matters outside our direct control, including mobile-network availability, device compatibility, carrier filtering, service interruptions and the accuracy of the mobile number provided.

We do not guarantee that every SMS message will be delivered or received within a particular timeframe.

9. Privacy

We handle personal information connected with the SMS Program in accordance with our Privacy Policy: https://artificersai.com/privacy-policy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be provided to other organisations except aggregators, telecommunications carriers and providers used to operate and deliver the text-message service.

10. Industry standards

The Artificer's AI SMS Program is intended to operate in accordance with applicable telecommunications-provider requirements, messaging-platform policies, opt-in and opt-out standards, content restrictions and responsible messaging practices.

We may suspend or restrict SMS communication where reasonably necessary to prevent fraud, misuse, unlawful activity, technical harm or violations of applicable messaging standards.

11. Prohibited conduct

You must not use our SMS communication channels to send unlawful, fraudulent, abusive, threatening, harassing, obscene or malicious material.

You must not use our SMS communication channels for phishing, social engineering, impersonation, malware distribution or attempts to obtain passwords, financial credentials or other sensitive information unlawfully.

12. Legal compliance

Our SMS Program is subject to applicable Australian laws and regulations, including the Spam Act 2003 (Cth), telecommunications requirements, consumer-protection laws and applicable privacy requirements.

Commercial SMS messages will only be sent where we have the recipient's consent or another lawful basis for sending the message. Commercial messages will identify Artificer's AI and provide a functional method for unsubscribing.

13. Changes to the SMS Program

We may modify, suspend or discontinue all or part of the SMS Program where reasonably necessary.

The effective date at the top of this page will indicate when the Terms were most recently updated.
